Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs the use of ZENIA Assistant and all related services, APIs, dashboards, and embedded widgets (collectively, the “Service”). It supplements the Terms of Service and is incorporated by reference into those Terms.

ZENIA Assistant is a software product operated under the ZENIA Assistant / buildbot.ro brand by Popescu Adrian Florin, an individual operator based in Romania.

By accessing or using the Service, you agree to this AUP in full. If you are using the Service on behalf of an organisation, you confirm that you have authority to accept and apply these rules on that organisation's behalf.

The policy may be updated from time to time. Material changes will be notified as described in Section 14.

You may only use the Service for lawful purposes and in a manner consistent with all applicable local, national, and international laws and regulations, including where applicable:
• Romanian law and European Union law, including GDPR, ePrivacy rules, the Digital Services Act, and AI-related transparency obligations.
• Laws and regulations that apply in the jurisdiction of your end users.
• Sector-specific rules that may apply to your business, including financial services, healthcare, legal, consumer protection, advertising, and professional-services rules.

Using the Service to facilitate, enable, or conceal illegal activity is strictly prohibited.

You are solely responsible for all content you provide to, configure in, or make available through the Service, including:
• Website URLs submitted for crawling.
• Files uploaded as knowledge sources (PDF, DOCX, TXT, MD, XML, and other supported formats).
• Custom text entered directly.
• Configuration, prompts, instructions, and public-facing chatbot behaviour.
• Chatbot responses generated and displayed on your website or application.

By submitting content, you represent that:
• You own or have obtained all necessary rights, licences, and permissions to use that content.
• The content does not infringe third-party intellectual property, privacy, confidentiality, publicity, or other rights.
• You have a valid legal basis for any personal data you submit, crawl, index, or otherwise process through the Service.
• You will not knowingly use false, deceptive, or misleading content in a way that harms users, third parties, or the integrity of the Service.

The Service does not pre-screen all user-supplied content and cannot verify the legal status, accuracy, or permissions of every submission you introduce into it.

The following conduct is prohibited:
• Using the Service in any way that violates this AUP, the Terms of Service, or applicable law.
• Attempting to gain unauthorised access to any system, account, workspace, API key, or data.
• Interfering with, disrupting, or degrading the integrity, performance, or availability of the Service or its infrastructure.
• Circumventing, bypassing, or undermining any security, authentication, rate-limiting, usage-limit, billing, or access-control mechanism.
• Reverse-engineering, decompiling, disassembling, or attempting to extract non-public source code or system prompts from any part of the Service, except where such restriction is not permitted by law.
• Reselling, sublicensing, or white-labelling the Service beyond the permissions expressly granted in your plan or written agreement.
• Impersonating ZENIA Assistant, the operator of buildbot.ro, Paddle, a customer, a visitor, or any other person or entity.
• Misrepresenting your identity, affiliation, legal authority, or the origin of content.
• Using the Service in a way that creates material legal, security, operational, or reputational risk for the service operator, other users, visitors, or third parties.

You may not submit, upload, crawl, index, configure, or generate content that:
• Is illegal, defamatory, obscene, hateful, or incites violence, harassment, or unlawful discrimination.
• Harasses, abuses, threatens, exploits, or violates the rights of any individual or group.
• Contains malware, viruses, trojans, spyware, ransomware, credential-stealing code, or other malicious code.
• Infringes any patent, trademark, trade secret, copyright, database right, or other intellectual-property right.
• Violates privacy or data-protection rights, including unlawfully processing personal data or publishing private information without a valid basis.
• Constitutes spam, unsolicited bulk communications, phishing content, social-engineering content, or deceptive credential collection.
• Promotes, enables, or facilitates fraud, scams, chargeback abuse, counterfeit activity, deceptive schemes, or financial crime.
• Depicts, promotes, solicits, or facilitates sexual exploitation of minors or child sexual abuse material (CSAM). Such material may be reported to law enforcement or relevant authorities.
• Is designed to impersonate a human support agent, licensed professional, public authority, or other person without appropriate disclosure where required by law.
• Provides instructions or operational assistance for violence, weapon misuse, self-harm, cyber abuse, evasion of law enforcement, or other clearly harmful activity.

The website crawl feature must only be used on websites and web pages that you own, operate, or have explicit written permission to crawl.

You must not use the crawl feature to:
• Crawl websites without authorisation from their owner.
• Bypass or override robots.txt directives or similar access-control signals.
• Extract competitor data, pricing, or proprietary information without authorisation.
• Harvest personal data from third-party websites.
• Violate any third-party site’s terms of service.

Crawl access may be suspended if complaints are received from third-party site owners or if unauthorised scraping activity is detected from your account.

When embedding the ZENIA chat widget on a website or application, you must:
• Only embed the widget on domains you own, control, or are authorised to manage.
• Provide appropriate notices to visitors about the use of an AI or automated assistant where required by law.
• Not use the widget to collect personal data beyond what is lawful, necessary, and disclosed in your own privacy notice.
• Not configure the chatbot to claim it is human, a licensed professional, a public authority, or a representative of any company other than your own in a manner that could deceive users.
• Comply with applicable laws requiring disclosure of AI or automated agent interactions, including EU AI Act transparency obligations where they apply.
• Not use the widget for phishing, credential harvesting, social engineering, manipulative dark patterns, or deceptive user flows.

You are responsible for the deployment, configuration, notices, and public behaviour of widgets you embed.

You may not use the Service to:
• Send unsolicited bulk messages or emails (spam).
• Conduct phishing, vishing, smishing, business-email-compromise, or social-engineering campaigns.
• Distribute malware, ransomware, spyware, malicious attachments, or malicious links.
• Harvest usernames, passwords, payment credentials, authentication tokens, API keys, or other sensitive information without authorisation.
• Commit or facilitate identity theft, payment fraud, financial fraud, or account takeover.
• Generate fake reviews, testimonials, endorsements, ratings, complaints, support conversations, or other deceptive trust signals.
• Automate the creation or distribution of misleading, deceptive, or fraudulent content at scale.

Each plan carries defined limits on messages, crawled pages, websites, file uploads, storage, API access, and other features. You may not:
• Create multiple accounts or workspaces to circumvent plan limits.
• Use automated scripts, bots, or shared credentials to artificially inflate or distribute usage.
• Attempt to bypass message-rate limits, crawl limits, file limits, storage limits, billing checks, or feature gates through technical manipulation.
• Share account credentials with persons not covered by your plan or workspace permissions.
• Abuse chargebacks, payment disputes, refunds, test accounts, trial accounts, or the Free plan to obtain access without payment.
• Use test accounts, early-access accounts, trial accounts, or the Free plan as a substitute for a paid subscription at commercial scale.

Accounts where evasion or payment abuse is detected may be rate-limited, suspended, downgraded, terminated, or billed for actual resources consumed, where permitted by law and the applicable payment/subscription process.

If your plan includes API access, you may use the API only for legitimate integrations consistent with the Service’s intended purpose. You may not:
• Use the API to send unsolicited messages or conduct spam campaigns.
• Automate interactions that violate this AUP or the Terms of Service.
• Use the API to probe, map, or attack service infrastructure or third-party services.
• Share your API keys publicly or allow them to be used by unauthorised parties.
• Use the API to re-export or resell Service functionality beyond your plan permissions.
• Construct requests that intentionally overload the Service (denial-of-service behaviour).

Excessive or abusive API usage may result in throttling, key revocation, or account suspension without prior notice.

The Service is a general-purpose AI chatbot and knowledge-assistant platform. It is not certified, validated, or approved for use in high-risk, regulated, or safety-critical contexts. You must not use the Service as the primary or sole decision-making mechanism for:
• Medical diagnosis, treatment recommendations, health triage, or patient-specific clinical decisions.
• Legal advice, legal representation, or binding legal determinations.
• Financial advice, investment recommendations, trading decisions, lending decisions, credit assessments, insurance eligibility, or other regulated financial decisions.
• Emergency response, crisis intervention, public safety, law enforcement, migration/asylum decisions, employment selection, education access, or other contexts where automated errors could materially affect rights, safety, or access to essential services.
• Any application where AI errors could reasonably cause physical harm, death, serious financial loss, serious legal consequences, or denial of essential services.

If you use the Service in a regulated sector, you are responsible for all required disclosures, professional review, licences, human oversight, risk assessment, and compliance measures.

The service operator reserves the right to take any of the following actions if it determines, acting reasonably and in good faith, that you have violated this AUP or created material risk:
• Issue a warning and require rectification within a specified period.
• Remove or disable access to content, sources, widgets, domains, API keys, or integrations.
• Suspend or restrict access to some or all features pending investigation.
• Terminate your account and associated access, subject to applicable law and the Terms of Service.
• Report unlawful activity to relevant law-enforcement authorities, regulators, payment processors, hosting providers, or affected third parties where appropriate.
• Retain logs, content, and metadata as reasonably necessary for investigations, security, fraud prevention, legal compliance, or dispute handling.

Where feasible, you will be notified before action is taken. In cases involving severe, ongoing, criminal, security-critical, or harmful conduct, action may be taken immediately without prior notice.

If you become aware of any use of the Service that violates this AUP, please report it promptly.

Abuse reports are reviewed and acted upon as quickly as reasonably possible. ZENIA treats abuse reports confidentially and will not disclose the identity of the reporter except where required by law.

Please include:
• A description of the suspected violation.
• The relevant URL, widget domain, or account identifier if known.
• Any supporting evidence (screenshots, logs, links).

This Acceptable Use Policy may be revised at any time. Material changes will be notified via email to the address registered on your account, by a notice in the dashboard, or by an update on this page.

The “Last updated” date at the top of this page indicates when the policy was last revised. Your continued use of the Service after the stated effective date constitutes your acceptance of the revised policy.

If you disagree with a revised policy, you must stop using the Service and may cancel your subscription in accordance with the Terms of Service.
